米国的法庭还素有点良心

贺梅案有感。Especially it's a unanimous decision by the Tennessee Supreme Court that reversed lower court rulings which had terminated the parental rights of her biological parents in 2004.

This poor little almost 8-year-old girl will probably be retured to her parents soon, but still this whole thing is very sad. Who does she think her parents are? After 6 or 7 years of prolonged legal battles while she lived and bonded with her foster family, I am not sure what outcome would be best for her.

久病成良医,贺梅的父母最后自己代表自己撰写了一份动议给田纳西最高法庭,其后的过程都无律师代表,这种精神和勇气非常令人敬佩。

这件事让我很感伤

If you look at the last page of the amicus brief by Dongxiao Yue, the Hes were represented by at least two counsels during the appeal to TNSC.

可是我也是看到岳博士写的一个什么文章,说贺的最后一个动议是没有律师代表的。

我不懂法律的。以你的理解为准。

Haha, I believe what Yue had said, but I think the motion the Hes wrote at the end had no substantive effect on the outcome of the case. Family law, and most non-statutory laws for that matter, is really complex – interpretation relies heavily on case law precedents. If the Hes could have braved (bravery alone does not cut it) the field successfully, they should not have gotten into this pile of s*** in the first place. Well, let it be a lesson for all. What the foster parent said on the CNN footage is completely bogus and ridiculous.
